Terms & Conditions
The agreement that covers your Tropic Arts account and your use of this website.
Effective October 21, 2026
These Terms & Conditions ("Terms") are a binding agreement between you and Tropic Arts LLC ("Tropic Arts," "we," "us," or "our") and govern your access to and use of the Tropic Arts website-building platform, including the account dashboard, editor, hosting, and any related tools, sites, and services we make available (together, the "Service"). Please read them carefully. By checking the box, clicking "Create account," or otherwise accessing or using the Service, you agree to these Terms. If you do not agree, do not create an account or use the Service.
Using our website. You don't need an account to use our website at tropic-arts.com. If you use it without one, sections 7 (Acceptable Use), 8 (Intellectual Property), 9 (Third-Party Services), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 16 (Governing Law), and 17 (General) apply to that use as though our website were part of the Service, and by using the website you agree to them.
1. Eligibility
You must be at least 18 years old to create an account and use the Service. By creating an account you represent and warrant that you are 18 or older, that the information you provide is accurate and complete, and that you have the authority to enter into these Terms — on your own behalf, or on behalf of the organization you represent, in which case "you" refers to that organization.
2. Your Account
To use the Service you create an account with your name and email address. When you sign up we email you a temporary password; you must set your own password before your account is active. You are responsible for:
- Providing accurate, current, and complete information and keeping it up to date
- Keeping your password and login credentials confidential
- All activity that occurs under your account, whether or not authorized by you
- Notifying us promptly at hello@tropic-arts.com if you suspect any unauthorized use of your account
You may not share your account, sell or transfer it without our consent, or create an account using someone else's identity. We may refuse, suspend, or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or abusively.
3. The Service
Tropic Arts lets you design, build, publish, and manage websites and online stores using our templates, editor, and hosting. We may add, change, or remove features over time. We may also offer some features on a free trial or introductory basis, and we may change or discontinue those at any time. We do not guarantee that the Service, or any particular feature, will always be available or error-free.
4. Plans, Fees, and Billing
Some parts of the Service are free and others require a paid plan. Where fees apply:
- The price, billing period, and what's included are shown at the time you choose or change a plan, and may change on a going-forward basis with notice
- Paid plans renew automatically for the same period until cancelled, and you authorize us (or our payment processor) to charge your selected payment method for the applicable fees and taxes
- Except where required by law or expressly stated, fees are non-refundable, and cancelling stops future charges rather than refunding the current period
- If a payment fails or an account is past due, we may suspend or downgrade paid features until the balance is resolved
5. Domain Names
You may register a domain name through the Service. When you do, we act as a reseller: the registrar of record is our upstream registrar for that ending, and the registration is governed by that registrar's agreement, by the registry operator's rules, and by ICANN's policies, in addition to these Terms. You are the registrant. The name is yours, and you may transfer it to another registrar.
- Price and renewal. The first-year price and the renewal price are shown to you before you buy, and they are often different. A domain renews automatically each year at the then-current renewal price, which we may change on a going-forward basis and which can change if the registry changes its own price. You authorize us to charge your payment method on file for each renewal.
- Renewal continues after your plan ends. A domain is not part of a plan. If you cancel your plan, downgrade, or close your site, the domain keeps renewing and you keep being charged for it, because the name remains yours until you say otherwise. You may turn off automatic renewal at any time, after which the domain expires at the end of its current term and we stop billing you for it. You may also transfer it away at any time, subject to the transfer restrictions below.
- Registrations are not refundable. Once a name is registered it cannot be un-registered — only allowed to expire — so registration fees and renewal fees are non-refundable, including where you cancel your plan mid-term. If a registration attempt does not complete, you are not charged for it.
- Availability is not guaranteed until the registry confirms it. A name shown as available may be taken between the moment you see it and the moment we submit the registration. Some names are reserved, premium-priced, or subject to registry-specific eligibility rules, and we may be unable to register them.
- ICANN requires accurate contact details. You must give, and keep current, a valid registrant name, postal address, telephone number, and email address. The registrar will email that address to verify it; if the verification goes unanswered for fifteen days the registry suspends the domain and your site stops resolving on it. Providing false contact details, or failing to keep them accurate, is a breach of ICANN policy and may result in suspension or cancellation of the registration by parties other than us.
- Transfers are locked for the first 60 days. ICANN prohibits transferring a newly registered domain to another registrar for 60 days after registration, and again after certain changes to the registrant contact. This is a policy we cannot waive.
- Abuse. We may decline to register a name, and may stop renewing one, where we reasonably believe it is being used in breach of section 7 or of applicable law. Because a registration cannot be reversed, our remedy in that case is to stop renewing it rather than to un-register it. To report a domain registered through the Service, email abuse@tropic-arts.com. We are a reseller rather than the registrar of record, so serious reports may also be raised with the registrar shown in that domain’s WHOIS record.
Domain fees are billed separately from your plan and are shown separately on your invoices. Our handling of the registrant contact record, including who receives it and why it cannot be deleted on request while the domain is live, is described in our Privacy Policy.
6. Your Content and Sites
You retain ownership of the content you upload, create, or publish through the Service ("Your Content") and of the sites you build. You grant Tropic Arts a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display Your Content solely as needed to operate, secure, improve, and provide the Service to you (for example, to serve your published site to visitors and to create backups).
You are solely responsible for Your Content and for the sites you publish, including making sure you have all necessary rights to it and that it — and your use of the Service — complies with all applicable laws and with any third-party terms (for example, payment, analytics, or marketing tools you connect). You are also responsible for your own compliance with privacy and consumer-protection laws in your dealings with your site's visitors and customers.
7. Acceptable Use
You agree not to use the Service to:
- Violate any law or regulation, or infringe anyone's intellectual-property, privacy, or other rights
- Publish or distribute content that is unlawful, defamatory, harassing, hateful, deceptive, or sexually exploitative, or that promotes violence or illegal activity
- Distribute malware, run phishing or fraud schemes, or send spam or unlawful marketing
- Attempt to gain unauthorized access to, disrupt, overload, or reverse-engineer the Service or its infrastructure, or circumvent any usage limits or security measures
- Resell, sublicense, or provide the Service to third parties except as expressly permitted, or scrape or copy the Service other than your own content
- Read or import a website that you don't own and don't have the right or authority to use this way
- Collect, store, or transmit protected health information — see Health information below
Health information. The Service is not built for protected health information, and you may not use it to collect, store, or transmit any. That means information about an identifiable person's physical or mental health, the health care they have received or are seeking, or payment for that care — a symptom, a condition, a diagnosis, a medication, a treatment or its history, or health-insurance details — whether it reaches us through a booking form, a message, an uploaded file, or anywhere else in the Service. This applies wherever you are: it covers protected health information under the U.S. Health Insurance Portability and Accountability Act ("HIPAA") and information given equivalent protection by health-privacy laws elsewhere.
We do not act as a business associate, and we do not enter into business associate agreements. If you are a health-care provider, a health plan, or anyone else handling health information on their behalf, you are welcome to run your marketing site here and to take appointment requests — provided what people give you through the Service is limited to who they are, how to reach you back, and when suits them. Have the clinical conversation by telephone, in person, or in a system built to hold it.
If we become aware that protected health information is being collected or held through the Service, we may remove it or disable the form or feature collecting it, and may suspend or terminate the site or account under section 14. Nothing in these Terms makes us responsible for your compliance with health-privacy law, and you remain solely responsible for it.
We may investigate suspected violations and may remove content or suspend or terminate accounts that we reasonably believe breach these Terms.
8. Intellectual Property
The Service — including our software, templates, designs, logos, and the Tropic Arts brand — is owned by or licensed to us and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service and its templates to build and operate your own sites. You may not copy, resell, or redistribute the templates or software as your own product, and you may not use our name or logos without our prior written permission. Any feedback or suggestions you share may be used by us without obligation to you.
9. Third-Party Services
The Service may integrate with or link to third-party products and services (for example, payment processors, domain registrars, analytics, or fonts). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their availability, content, or practices. Connecting a third-party service is at your own risk.
Stock photos. Some features let you search a free stock-photo library, currently Pixabay, and put its photos on your site, and our site builder may place them where a picture only sets a scene. We send the library your search words and nothing else about you or your customers, so don't put names or anything about your customers in a search. Photos from the library are marked as stock in the Service, and your use of them is subject to the library's license (for Pixabay, the Pixabay Content License, at https://pixabay.com/service/license-summary/). Among other things, you may not:
- sell or distribute a stock photo on its own or substantially unchanged (resizing, cropping or applying a filter doesn't make it a new work);
- use one in a way that suggests anyone in it, or any brand or creator, endorses or is affiliated with you, or that you created it or have exclusive rights to it;
- use one in a trademark, logo, design mark, trade name, business name or service mark;
- use a photo showing a recognizable trademark, logo or brand commercially in connection with goods or services, where the license prohibits that.
The library doesn't promise that a photo is free of other people's rights, such as trademark, privacy or publicity rights, or the need for a model or property release. Check that a photo suits your use before you publish it, and replace it if anyone objects. Use stock photos only through the Service, and don't download them in bulk.
Some features of the Service use artificial intelligence. When you use one, what it needs to do what you asked, including your instructions, the text and files you give it, and the text of any website you ask us to read, is sent to our AI provider, currently Anthropic, PBC. The exception is a feature that runs on a model we host ourselves. When available, background removal will process the photo you choose using a model we host on AWS; the feature will not send that photo to Anthropic. The generated image will be saved in your site storage alongside the original. Review the result and confirm you have the rights needed before publishing. AI output can be wrong or imperfect, so check it before you publish it. Our Data Processing Agreement lists our providers and what each receives.
Two of these features act on what your customers and visitors write. Reply drafts suggest a reply or note to one of your customers about a message, review or booking; you must review each draft before you send it, and nothing is sent to the customer until you do. If you switch on automatic drafting, each email a customer sends to your site's Inbox is sent to our AI provider as it arrives, to draft a reply for you to review and to sort your Inbox by how urgent it appears; that order is a suggestion and can be wrong. The site chat answers visitors to your website once you switch it on, and what they type into it is sent to our AI provider to produce answers. You are responsible for deciding whether to switch the chat or automatic drafting on and whether each suits your business, for keeping your site's public content and business settings accurate, and for responding to the visitors it passes to you and to the customers who write to you. AI answers may be incomplete or wrong and should not be treated as authoritative, and the chat cannot book, change or cancel appointments or take payments. We remain responsible for the obligations that applicable law places on us and for providing these features as described.
10. Privacy and Data Processing
Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to that processing. We send you administrative and transactional messages (such as your temporary password, security notices, and billing receipts) as part of providing the Service.
When you use the Service we also process personal data on your behalf, for example about your site's visitors and customers, or found on a website you ask us to read, including before you have created a site. For that processing you are the controller and we are your processor, under our Data Processing Agreement (the "DPA"), available at https://app.tropic-arts.com/dpa. The DPA forms part of these Terms. If these Terms and the DPA conflict about personal data, the DPA controls.
11. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that any content or data will be preserved without loss. You are responsible for maintaining your own backups of important content where practical.
12. Limitation of Liability
To the fullest extent permitted by law, Tropic Arts and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or one hundred U.S. dollars ($100).
13. Indemnification
You agree to indemnify and hold harmless Tropic Arts and its owners, employees, and agents from and against any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of or related to Your Content, your sites, your use of the Service, or your violation of these Terms or of any law or third-party right.
14. Suspension and Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends. We may delete your account and content after a reasonable period following termination or prolonged inactivity; where practical we will give you an opportunity to export your content first. Provisions that by their nature should survive termination — including ownership, fees already due, disclaimers, limitations of liability, and indemnification — will survive.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date and version above and, where appropriate, notify you or ask you to accept the revised Terms. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
16. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Florida, and you consent to personal jurisdiction there, except where applicable law gives you the right to bring a claim elsewhere.
17. General
These Terms, together with our Privacy Policy, our Data Processing Agreement, and any plan or order terms you accept, are the entire agreement between you and Tropic Arts regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
